An 80-year-old Wairarapa man has been granted continued name suppression after pleading not guilty to two counts of obscene exposure.
The man appeared in Masterton District Court yesterday where his lawyer Ian Hard argued for a discharge without conviction on the grounds his client had a clean criminal record and was not "aware of his own state" on the day the incident occurred.
Judge Jan Kelly quashed the plea saying the alleged incident was "unfortunate, but it's not to be minimised and needs to be marked by a conviction".
Police are alleging the man exposed his genitals through his trouser fly.
The man's lawyer said his client - who also has cancer - may have had "a diabetic turn" and "his awareness of own state was not good on that day". He said the man was deeply embarrassed.
